Article 58 of Peru's Consumer Protection and Defence Code prohibits commercial calls, SMS and emails to consumers without their prior, express consent, and the Personal Data Protection Law 29733 also applies.

In North America, business texting is shaped by carrier rules as well as law: in the US, application-to-person messaging on standard numbers generally requires brand and campaign registration (10DLC), and the TCPA requires appropriate consent.   • Identify your business in every message and keep promotional and service messages separate.
  • Give a simple way to opt out of marketing and process opt-outs quickly across all your systems.
  • Send in the recipient's local daytime hours and keep frequency reasonable.

Format numbers in international E.164 format with the +51 country code, remove duplicates and invalid numbers, and keep consent records linked to each number.

Timing and Language

Peru follows the America/Lima time zone (UTC-05:00 in October 2026). The usual working week is Monday to Friday. Schedule SMS campaigns for the recipient's local daytime hours, avoid public holidays and religious observances that matter to your audience, and convert send times from IST before scheduling.

In Lima, customers commonly use Spanish. Messages in the customer's preferred language usually perform better, but check how local-language text affects character counts (for SMS) and template approval (for WhatsApp).

Peru is a WhatsApp-first market, and Facebook and TikTok drive discovery. Law 29733 on personal data protection requires consent for marketing, and promotional messages must offer an opt-out.

Yape and Plin mobile wallets are used by millions for everyday payments, alongside cards and cash. Fiestas Patrias in July, Cyber Wow sales, Mother's Day and Christmas shape demand.

Peru's economy is built on mining (copper, gold, zinc and silver), agricultural exports such as blueberries, avocados, grapes and asparagus, fishmeal from the anchovy catch, and a growing services sector in Lima. The general sales tax (IGV) is 18%, and prices are quoted in soles. INDECOPI runs the 'Gracias... No Insista' register: numbers and email addresses on it must be excluded from commercial calls, SMS and mass messages, and senders should check it before each campaign. Spanish is the main business language, while Quechua and Aymara are widely spoken in the Andes.

Regulators, Registers and Practical Rules in Peru

In Peru, the Personal Data Protection Law (Law 29733) is supervised by the National Authority for Personal Data Protection (ANPD) under the Ministry of Justice, and new regulations approved in 2024 updated the rules. The Consumer Protection Code bans calls, SMS and emails for marketing without prior consent, and INDECOPI runs the "Gracias, no insista" register that companies must respect. OSIPTEL regulates telecoms. Claro, Movistar, Entel and Bitel are the operators.

Spanish is used for almost all messaging, with Quechua or Aymara helpful in some Andean regions. Yape and Plin are widely used for payments.

OSIPTEL also runs a register of mobile lines.

Including the company's RUC (tax number) and a verifiable contact number helps Peruvian customers trust the sender, as SMS fraud is common.
