- Consent: express consent, or implied consent in limited situations
- Identification: your name, brokerage and contact information in each message
- Unsubscribe: a working mechanism in every message, processed within 10 business days
Express vs implied consent
Express consent is a clear opt-in, such as an unchecked box on your website saying "Yes, send me new listing alerts and market updates from [Name], [Brokerage]". It does not expire unless withdrawn.
Implied consent applies in limited situations, such as an existing business relationship from a purchase or contract within the past two years, or an enquiry within the past six months. Implied consent expires, so convert contacts to express consent where you can.
Common realtor mistakes under CASL
- Adding open house sign-in contacts to a newsletter without consent
- Texting numbers collected from lawn signs or purchased lists
- Sending "just listed" or "just sold" campaigns to people with no relationship

6. Privacy law
Personal information you collect, such as names, phone numbers and property details, is protected by PIPEDA or provincial privacy laws in Quebec, Alberta and British Columbia. Explain how you will use information, keep it secure and only share it as permitted.
