Overview

Chile's Consumer Protection Law (Law 19.496) requires promotional messages to identify the sender and show how to stop receiving them, and consumers can register on SERNAC's 'No Molestar' list to block marketing calls and messages.

Personal data is governed by Law 19.628, and the new Personal Data Protection Law 21.719, with a dedicated data protection agency, takes effect in December 2026.

Spanish is the search language and Google is dominant; Chilean Spanish has its own vocabulary, so local copy should be reviewed.

WhatsApp is a major business channel in much of Latin America, while in the US and Canada it is used alongside SMS. Consent and data protection laws in each country apply to WhatsApp marketing.

Automated and prerecorded calls are tightly regulated in the US (TCPA and the National Do Not Call Registry) and Canada (CRTC Unsolicited Telecommunications Rules), and other countries in the region have their own registers and rules.

Digital Habits and Channels in Chile

Chile has high internet and smartphone use, and WhatsApp is the main messaging app, with Instagram driving discovery. Chile's new personal data protection law (Law 21.719) was enacted in 2024 and creates a data protection agency, with obligations phasing in by December 2026.

Cards, bank transfers and WebPay are the main online payment methods. CyberDay, Black Friday, Fiestas Patrias in September and Christmas are key periods.

Chile is the world's largest copper producer, and mining, lithium from the Atacama salt flats, salmon farming, wine and fresh fruit exports drive the economy, with Santiago concentrating most corporate headquarters, banks and retailers such as Falabella and Cencosud. VAT (IVA) is 19%. Consumers can sign up to SERNAC's 'No Molestar' register to block advertising calls, SMS, WhatsApp and email from specific companies, so suppression lists must be honoured promptly. The main mobile operators are Entel, Movistar, Claro and WOM.

Regulators, Registers and Practical Rules in Chile

Chile's new data protection law, Law 21.719, creates a Personal Data Protection Agency and takes full effect in December 2026. SUBTEL regulates telecoms. Entel, Movistar, Claro and WOM are the operators.

Under the Consumer Protection Law, promotional messages must state how to unsubscribe, and once a person asks to stop, further messages are prohibited. The CyberDay and Black Friday campaigns produce large spikes in e-commerce traffic, and sender reputation matters during these weeks.
