The rules in plain English

TCPA and consent

The TCPA restricts calls and texts made with an autodialer or using prerecorded or artificial voices, and FCC rules treat texts as calls for these purposes. For marketing texts sent through automated platforms, the safest approach is to obtain prior express written consent: a clear agreement, which can be electronic, such as a checked box on a web form, that authorises you to send marketing texts to the number provided, and states that consent is not a condition of purchase.

Informational texts that a consumer asked for, such as a showing confirmation, generally need at least prior express consent. When in doubt, treat a message as marketing.

Consent revocation

Consumers can revoke consent in any reasonable way, including replying "STOP", "quit", "cancel" or similar words, or saying they no longer want messages. Process opt-outs promptly and keep records.

National Do Not Call Registry

Telemarketing calls and texts to numbers on the National Do Not Call Registry are restricted unless you have the consumer's consent or an established business relationship within the rules' limits. Cold texting numbers from purchased lists is high risk.

State laws

Several states, including Florida and Oklahoma, have their own telemarketing laws with additional requirements, and others have quiet-hour rules. Check the laws of the states where your contacts live.

  • Website forms: an unchecked consent box with clear text naming your business, describing the messages, noting that message and data rates may apply, that consent is not a condition of purchase and how to opt out
  • Open house sign-in: a digital sign-in form with the same consent language
  • Listing portals: check the portal's terms on what consent the lead has given and to whom
  • Keyword opt-in: "Text HOMES to [number] for new listings in [area]", with a confirmation message

Store a record of when and how each person consented.

Under the federal Fair Housing Act, advertising must not indicate a preference, limitation or discrimination based on race, colour, religion, sex, disability, familial status or national origin, and state laws often add more protected classes. Describe properties, not the people you think should live in them. Avoid phrases such as "perfect for young professionals" or "ideal for families", and target new listing alerts by property criteria the buyer chose, not by personal characteristics.
