Overview
The Swedish Marketing Act requires prior consent for marketing to individuals by SMS and email, with an exception for similar products offered to existing customers who were given the chance to opt out. The Consumer Agency (Konsumentverket) enforces it, and IMY supervises the GDPR.
The Swedish Authority for Privacy Protection (IMY) enforces the GDPR, including rules on cookies and analytics.
Swedish is the main search language, but English is widely understood; local Swedish content still performs best with consumers.
In Europe, WhatsApp marketing is treated like other electronic marketing: you need a lawful basis, usually consent, and you must be transparent about how contact data is used under GDPR or UK GDPR.
European countries regulate marketing calls through national laws and do-not-call or objection registers, and automated (recorded) marketing calls generally require prior consent.
