Overview
In Portugal, marketing SMS and email to individuals require prior consent under Law 41/2004 on privacy in electronic communications and the GDPR, with an exception for similar products offered to existing customers. Each message must allow a free opt-out, and the CNPD supervises data protection.
The CNPD enforces the GDPR and Law 58/2019, and websites need a clear privacy policy and consent before non-essential cookies.
European Portuguese is the search language; spelling and vocabulary differ from Brazilian Portuguese, so copy should be adapted for Portugal rather than reused.
In Europe, WhatsApp marketing is treated like other electronic marketing: you need a lawful basis, usually consent, and you must be transparent about how contact data is used under GDPR or UK GDPR.
