Overview

In Italy, marketing SMS require prior consent under the Privacy Code (Legislative Decree 196/2003) and the GDPR, and the Garante per la protezione dei dati personali regularly fines unlawful marketing campaigns.

The Garante enforces the GDPR and its 2021 cookie guidelines, which require consent for non-essential cookies and a clear way to reject them.

Italian is the language of search and Google is dominant; regional searches often include the town or province name.

In Europe, WhatsApp marketing is treated like other electronic marketing: you need a lawful basis, usually consent, and you must be transparent about how contact data is used under GDPR or UK GDPR.

European countries regulate marketing calls through national laws and do-not-call or objection registers, and automated (recorded) marketing calls generally require prior consent.

Advertising follows the Consumer Code and the IAP self-regulatory code; AGCOM's 2024 guidelines require influencers with large audiences to label advertising clearly.

Digital Habits and Channels in Italy

Italy has high smartphone use, and WhatsApp is the dominant messaging app for both personal and business chat. SMS is common for appointment reminders, deliveries and bank codes, and alphanumeric sender IDs are supported. Italy's updated Registro delle Opposizioni since 2022 also covers mobile numbers, so telemarketing lists must be checked against it.

Cash is still used more than in northern Europe, but cards, contactless payments, PayPal and Satispay are growing fast, and many families rely on PagoPA for public payments. Business culture values personal relationships and phone calls. The calendar includes the winter and summer sales (saldi), Ferragosto in mid-August when many businesses close, Black Friday and Christmas, and regional holidays for each city's patron saint.

Italy's economy includes manufacturing (machinery, cars, fashion, furniture), food and wine, and tourism. VAT is 22%. The Registro Pubblico delle Opposizioni lets consumers opt out of telemarketing calls, and since 2022 it also covers mobile numbers. Satispay and PayPal are popular online payment methods alongside cards.
