Overview

In France, B2C marketing by SMS requires prior consent under article L34-5 of the French Postal and Electronic Communications Code and the GDPR, as enforced by the CNIL. Each message must identify the sender and include a free way to opt out, typically by replying STOP.

French websites must comply with the GDPR and CNIL guidance, including consent before non-essential cookies, with refusing made as easy as accepting, and a clear privacy policy.

French is the language of search in France and Google is dominant; content should be written natively in French rather than machine-translated to be credible.

In Europe, WhatsApp marketing is treated like other electronic marketing: you need a lawful basis, usually consent, and you must be transparent about how contact data is used under GDPR or UK GDPR.

European countries regulate marketing calls through national laws and do-not-call or objection registers, and automated (recorded) marketing calls generally require prior consent.

France has high smartphone use, and WhatsApp is the leading messaging app, while SMS remains common for appointment reminders, deliveries and bank authentication. Industry practice, backed by the operators' professional code, limits marketing SMS to daytime hours from Monday to Saturday and excludes Sundays and public holidays, and every promotional message carries a 'STOP' opt-out keyword.

Carte Bancaire debit cards dominate payments, often in contactless form, and Lydia and Paylib are used for transfers between people. The government-regulated sales periods (soldes) in January and summer are major retail moments, along with Black Friday, Christmas and la rentrée in September. French language rules mean consumer-facing content and terms must be available in French.

France's economy includes aerospace (Airbus in Toulouse), luxury goods (LVMH, Kering, Hermès), food and wine, nuclear energy, pharmaceuticals and the world's most visited tourist destination. The standard VAT (TVA) rate is 20%. Consumers can block telemarketing calls through Bloctel, and since 2023 marketing calls are limited to weekdays from 10 am to 1 pm and 2 pm to 8 pm. The CNIL actively fines companies for sending marketing without valid consent. The Carte Bancaire network and PayPal are the main online payment methods, and the January and July sales periods are set by law.
